1. Nature of the service

VolleyDesk jest systemem informatycznym przeznaczonym do obsługi meczów i turniejów siatkarskich. Obecnie system udostępniany jest wyłącznie w fazie testów (BETA).

VolleyDesk is a software system for managing volleyball matches and tournaments. It is currently available exclusively in the beta testing phase (BETA).

• System nie stanowi wersji produkcyjnej.
• The system is not a production version.
• Funkcjonalności mogą być niekompletne lub niestabilne.
• Features may be incomplete or unstable.
• Usługa udostępniana jest nieodpłatnie.
• The service is provided free of charge.

2. Dostęp i korzystanie

Korzystanie z systemu VolleyDesk w fazie BETA ma charakter dobrowolny.

Use of the VolleyDesk system during the BETA phase is voluntary.

• Użytkownik korzysta z systemu na własną odpowiedzialność.
• The user uses the system at their own risk.
• Dostęp do systemu może zostać ograniczony lub wyłączony w dowolnym momencie.
• Access to the system may be restricted or disabled at any time.
• Nie jest gwarantowana ciągłość działania ani dostępność usługi.
• Continuity of operation or availability of the service is not guaranteed.

3. Dane i konta użytkowników

3. User data and accounts

System działa w fazie BETA, jednak użytkownik może wprowadzać zarówno dane testowe, jak i rzeczywiste dane dotyczące klubów, zawodników, turniejów i meczów.

The system is in the BETA phase, but users may enter both test data and real data concerning clubs, players, tournaments and matches.

• Użytkownik nie może wprowadzać treści ani danych, do których wykorzystania nie ma prawa lub innej odpowiedniej podstawy. Zakres wprowadzanych danych osobowych powinien być ograniczony do informacji potrzebnych do korzystania z wybranych funkcji systemu.
• Users must not enter content or data that they have no right or other appropriate legal basis to use. Personal data entered into the system should be limited to information needed to use the selected functions.
• Ze względu na rozwój wersji BETA struktura lub sposób prezentacji danych może się zmieniać. Operator dokłada starań, aby nie powodowało to nieuzasadnionej utraty danych.
• Because the BETA version is under development, the structure or presentation of data may change. The operator makes reasonable efforts to avoid unjustified data loss.
• Konto lub treść może zostać ograniczona albo usunięta w razie naruszenia regulaminu, prawa, bezpieczeństwa systemu lub praw innych osób, a także na żądanie użytkownika w zakresie przewidzianym prawem.
• An account or content may be restricted or removed if it violates these terms, the law, system security or the rights of others, or at the user's request where provided by law.

4. Sponsorzy i prezentacja partnerów klubów

4. Sponsors and presentation of club partners

VolleyDesk umożliwia klubom i organizatorom turniejów dodawanie własnych sponsorów (logotypy, linki, opisy) i prezentowanie ich na profilu klubu oraz na stronach publicznych turnieju.

VolleyDesk allows clubs and tournament organizers to add their own sponsors (logos, links, descriptions) and present them on the club's profile and on the tournament's public pages.

• Sponsorzy prezentowani w systemie są sponsorami danego klubu lub organizatora, a nie partnerami VolleyDesk. VolleyDesk udostępnia wyłącznie miejsce techniczne do ich prezentacji i nie jest stroną żadnej umowy sponsorskiej.
• Sponsors presented in the system are sponsors of the given club or organizer, not partners of VolleyDesk. VolleyDesk only provides the technical space for their presentation and is not a party to any sponsorship agreement.
• Za treść, legalność i zgodność logotypów oraz opisów sponsora z prawem odpowiada klub lub organizator, który je dodał.
• The content, legality and compliance of sponsor logos and descriptions rests with the club or organizer who added them.
• Jeśli klub lub organizator zaznaczy zgodę na dodatkową prezentację sponsora w neutralnych miejscach systemu (np. w panelu głównym innych użytkowników), sponsor może zostać pokazany także poza stroną tego klubu/turnieju — po wcześniejszej weryfikacji przez operatora systemu. Prezentacja taka nie oznacza partnerstwa ani rekomendacji ze strony VolleyDesk.
• If a club or organizer opts in to additional presentation of a sponsor in neutral areas of the system (e.g. in other users' main panel), the sponsor may also be shown outside that club's/tournament's own page — after review by the system operator. Such presentation does not imply partnership or endorsement by VolleyDesk.
• Operator systemu może odmówić dopuszczenia sponsora do prezentacji poza stroną własną klubu/turnieju lub usunąć go z takiej prezentacji w dowolnym momencie, bez podania przyczyny.
• The system operator may refuse to allow a sponsor to be presented outside the club's/tournament's own page, or remove it from such presentation at any time, without giving a reason.

5. Treści, zdjęcia, logotypy i wizerunek

5. Content, photographs, logos and image rights

• Osoba dodająca treść oświadcza, że ma prawo do jej wykorzystania i publikacji, w tym odpowiednie prawa autorskie, licencję albo zgodę uprawnionej osoby.
• A person uploading content represents that they have the right to use and publish it, including the relevant copyright, licence or permission from the entitled person.
• Przed opublikowaniem zdjęcia lub nagrania zawierającego rozpoznawalny wizerunek należy posiadać wymaganą prawem podstawę jego rozpowszechniania.
• Before publishing a photograph or recording containing an identifiable person, the uploader must have the legal basis required for its dissemination.
• W przypadku dziecka osoba publikująca musi działać ze szczególną ostrożnością oraz posiadać uprzednią, odpowiednią zgodę rodzica lub opiekuna prawnego, jeżeli jest wymagana. Zgoda na udział w wydarzeniu nie oznacza automatycznie zgody na publikację wizerunku.
• For a child, the publisher must exercise particular care and have the prior appropriate consent of a parent or legal guardian where required. Consent to participate in an event does not automatically constitute consent to publish the child's image.
• Zabronione są treści bezprawne, naruszające prywatność, dobra osobiste lub prawa autorskie, nawołujące do przemocy lub nienawiści, pornograficzne, oszukańcze, złośliwe albo zagrażające dzieciom.
• Illegal content, content infringing privacy, personal rights or copyright, promoting violence or hatred, pornographic, fraudulent or malicious content, and content endangering children is prohibited.
• Nie należy publikować zbędnych danych dzieci ani informacji ułatwiających ustalenie ich miejsca pobytu, szkoły, adresu lub danych kontaktowych.
• Unnecessary data about children, or information facilitating identification of their location, school, address or contact details, must not be published.

6. Zgłoszenia i moderacja

Treść naruszającą prawo, prywatność, prawa autorskie lub bezpieczeństwo dziecka można zgłosić przez funkcję „Zgłoś” dostępną w systemie albo na adres volley@volleydesk.eu. Zgłoszenie powinno wskazywać link lub miejsce publikacji, opisywać problem i zawierać dane pozwalające na kontakt, jeżeli zgłaszający chce otrzymać informację o wyniku.

Content infringing the law, privacy, copyright or child safety may be reported using the “Report” function available in the system or by e-mail to volley@volleydesk.eu. A report should identify the link or publication location, describe the issue and include contact details if the reporter wishes to be informed of the outcome.

• Operator potwierdza przyjęcie zgłoszenia, jeżeli zgłaszający podał działający adres kontaktowy, i rozpatruje zgłoszenie bez zbędnej zwłoki. Zgłoszenia dotyczące bezpieczeństwa dziecka lub bezpośredniego zagrożenia są traktowane priorytetowo.
• The operator acknowledges receipt where the reporter provided working contact details and reviews the report without undue delay. Reports concerning child safety or an immediate threat are given priority.
• W czasie wyjaśniania operator może zabezpieczyć dowody, czasowo ograniczyć widoczność treści, a po ocenie pozostawić ją bez zmian, ograniczyć, usunąć lub zastosować ograniczenie konta. Działania powinny być adekwatne do charakteru naruszenia.
• While reviewing a report, the operator may preserve evidence and temporarily restrict content visibility. Following assessment, the content may remain unchanged, be restricted or removed, and account restrictions may be applied. Actions should be proportionate to the nature of the violation.
• Jeżeli podano dane kontaktowe, zgłaszający otrzymuje informację o rozstrzygnięciu, o ile przekazaniu takiej informacji nie sprzeciwiają się przepisy, bezpieczeństwo lub prawa innych osób. Osoba publikująca może zostać poinformowana o ograniczeniu jej treści.
• Where contact details were provided, the reporter is informed of the outcome unless disclosure would conflict with the law, security or the rights of others. The publisher may be informed that their content has been restricted.
• Zgłaszający lub osoba, której treść ograniczono, może poprosić o ponowne rozpatrzenie decyzji, odpowiadając na otrzymaną wiadomość albo pisząc na wskazany wyżej adres.
• A reporter or a person whose content was restricted may request reconsideration by replying to the received message or writing to the address above.

• utracone dane, wyniki lub protokoły meczowe,
• lost data, results or match protocols,
• przerwy w działaniu systemu,
• interruptions in system operation,
• błędy, nieprawidłowe działanie lub brak funkcji,
• errors, malfunction or missing features,
• skutki treści wprowadzonych lub publicznie udostępnionych przez użytkowników.
• the consequences of content entered or publicly shared by users.

8. Własność intelektualna

System VolleyDesk, w tym jego kod źródłowy, kod wynikowy, struktura, mechanizmy działania, interfejs, grafiki, układy ekranów, nazwa, logo oraz oznaczenia „VolleyDesk” i „VD”, stanowią własność operatora systemu lub są używane na podstawie odpowiednich uprawnień.

The VolleyDesk system, including its source code, object code, structure, mechanisms, interface, graphics, screen layouts, name, logo and the "VolleyDesk" and "VD" designations, are the property of the system operator or are used under appropriate rights.

• Elementy systemu są chronione przepisami prawa autorskiego oraz innymi właściwymi przepisami prawa.
• System elements are protected by copyright law and other applicable laws.
• Użytkownik nie nabywa żadnych praw do kodu, projektu, marki ani innych elementów systemu poza prawem do korzystania z systemu zgodnie z regulaminem.
• The user does not acquire any rights to the code, design, brand or other system elements except the right to use the system in accordance with these terms.
• Zabronione jest kopiowanie, rozpowszechnianie, modyfikowanie, odtwarzanie, dekompilowanie, reverse engineering lub wykorzystywanie elementów systemu poza zakresem wyraźnie dozwolonym przez operatora.
• Copying, distributing, modifying, reproducing, decompiling, reverse engineering or using system elements beyond the scope expressly permitted by the operator is prohibited.

9. Zmiany regulaminu

9. Changes to terms

Regulamin może być aktualizowany wraz z rozwojem systemu lub zmianą prawa. O istotnej zmianie użytkownik posiadający konto zostanie poinformowany w systemie i może zostać poproszony o akceptację nowej wersji przed dalszym korzystaniem z panelu.

These terms may be updated as the system develops or the law changes. Account holders will be informed in the system of material changes and may be asked to accept the new version before continuing to use the panel.

Korzystanie z systemu VolleyDesk w fazie BETA oznacza pełną akceptację niniejszego regulaminu.

Using the VolleyDesk system during the BETA phase constitutes full acceptance of these terms.
